General Rules & Conditions

  1. Definitions.

    “BC” means Breeders Challenge, LLC “Participant” means any rider, owner, nominator, stallion owner, or other person who enters, competes in, appears at, or is otherwise involved in an event conducted or sanctioned by BC. “Rules” means these General Rules & Conditions of Breeders Challenge, LLC, together with any event-specific conditions, written bulletins, addenda, or published policies that BC issues for a particular event, in each case as amended by BC from time to time.
  2. Participant Conduct. Participants are expected to conduct themselves in a courteous manner at all times. BC reserves the right to refuse service or draw out any Rider or Owner for inappropriate conduct, material policy violations, animal-welfare concerns, conflicts with management, or any other dispute that cannot be settled prior to an event.

  3. Animal Abuse. There will be zero tolerance for animal abuse of any kind. Excessive whipping, force, use of shock devices, or blood drawn will result in disqualification and immediate removal from the venue where appropriate and may result in suspension or permanent ban from the active event and future events. Failure to provide horse(s) with a clean, properly bedded stall, withdrawal of food or water will not be tolerated. This includes any and all activity while at a BC sanctioned event.

  4. Public Statements. Negative, misleading, slanderous, defamatory, knowingly false, or inappropriate content on social media outlets, public forums, or any other form of outreach will not be tolerated. Specific or general references to “Breeders Challenge”, “BC”, Jade Martin, or Lainie Whitmire are covered by this policy. Participants in violation will be removed from the program temporarily or permanently at BC’s sole discretion, with no refund of amounts already expended on event operations. Participants are expected to conduct themselves in a professional manner in regard to BC and its affiliated parties. Should inappropriate conduct commence following a written statement made by BC to the Participant in question, further legal action may take place at BC’s discretion. Nothing in this section limits any person’s ability to make truthful statements to a government agency or law enforcement authority. Any violation of this section by a Rider will be chargeable to and enforceable against the Owner of the entered horse. BC may impose penalties and disciplinary measures on the Owner, including without limitation disqualification, suspension, assessment of administrative or disciplinary fees, forfeiture of fees already applied to event operations, and program bans, regardless of the Owner’s presence or awareness. Any penalty imposed is in addition to, and not in lieu of, any penalty directed at the Rider.

  5. Publicity; Media License. By submitting an entry or participating in any event conducted or sanctioned by BC, each Participant (a) consents to the capture of their name, image, likeness, voice, performance, and biographical information (the “Materials”); and (b) grants BC a perpetual, worldwide, royalty-free, irrevocable license to use the Materials, and to record, edit, reproduce, distribute, publicly display, publicly perform, and create derivative works from the Materials, in any media now known or later developed, for the promotion, documentation, broadcast, or other lawful purposes of BC and its event partners and media distributors. Participants waive any right to further notice, approval, or compensation for such uses and waive any right to inspect or approve any recording, photograph, or finished product in which the Materials appear. To the fullest extent permitted by law, Participants release BC and its designees from claims arising out of the authorized use of the Materials, including claims based on rights of publicity or privacy. If a Participant brings or permits a minor whose appearance may be captured, the Participant represents that they are authorized to grant the foregoing on the minor’s behalf.

  6. Forward Advancement. Forward advancement in the alleyway begins at the initiation of the run. Riders may not ask or allow horses to intentionally circle, back up, or fail to continue forward advancement while in the alleyway. The only exception will be if the gate attendant or other unexpected outside entity impedes forward advancement prior to the run commencing. In this instance, the forward advancement ruling will be dismissed. BC reserves the right to review and enforce the final ruling should an advancement be questioned.

  7. Schooling; Circling; Pattern. A Rider may not school on a horse during a run. If a rider circles a barrel more than once, they will be disqualified and fined $500. If the Rider breaks pattern, a “no time” will be enforced.

  8. Timer Failure; Re-runs. A re-run will be granted if the timer fails to clock the run. The Rider will be given the opportunity for a re-run at the end of the next drag, or a re-run at the end of the race following a drag. The re-run will be considered a clean-slate run, and all applicable race rules will be applied. If a Rider knocks a barrel over during their run and they keep all three barrels standing during the re-run, the knocked-over barrel will not apply to the re-run.

  9. Hit Barrels; No Time. If a rider knocks a barrel over, +5.0 seconds will automatically be applied for each barrel knocked over. Hit barrels will not be considered a “no time”; all times will count so long as the pattern is not broken.

  10. Clocking; Payouts; Rollovers. Each run will be clocked individually toward a single payout or average payout depending upon the entered race. Runs may be rolled from one division to another; entry must be received and paid prior to the run to be eligible for any rollovers.

  11. Check-In; Draw-Out. Riders must be checked in the drag before they run. A 3-2-1 call will occur at the discretion of the announcer to confirm readiness; failure to appear after the 3-2-1 may result in draw-out. If a rider is drawn out, they will receive a “no time” and forfeit inclusion in the average.

  12. Dress Code. The dress code for all Participants shall be long sleeve shirt, full-length pants, western boots, helmet, or western hat. BC may publish different requirements for specific events in advance.

  13. Heath Documents. A current Coggins and health certificate must accompany each horse entered for a race. Unless otherwise specified, Coggins must be dated within 6 months and health certificates within 30 days of arrival. Participants agree to comply with the general requests, rules, and health requirements of the venue and applicable regulations.

  14. Timer Requirement. For a horse to receive any form of payout at the qualifier level, challenger level, semi-finals level, or finale level, they must pass the eye entering the arena to initiate the timer and pass the eye leaving the arena to stop the timer. Failure to do so will forfeit any form of awards presentation and monetary payout to Owner, Stallion Owner, and Nominator.

  15. Advancement on Scratches (Qualifier). Qualifier advancements of horses due to a scratch will be carried out through the discretion of BC management.

  16. Advancements on Scratches (Finalist after Draw Party). Finalist advancements of horses due to a scratch following the draw party will be carried out through up to one (1) hour preceding the start time of the race. The draw position will be automatically assigned to the horse moving into the scratched horse’s position.

  17. Vitrified embryos. Vitrified embryos sired by an enrolled stallion or fast pass stallion the year of vitrification will be honored for foal enrollment into the program for up to two (2) years beyond the stallion’s removal from the program. BC reserves the right to request documents pertaining to proof of embryo production in accordance with vitrification requirements. Written statements specifying details of the embryo will be required, including (i) Stallion Owner, (ii) onsite insemination date or shipment date including dam’s registered name and registration number, (iii) laboratory performing vitrification and thaw, (iv) date of embryo vitrification or date of I.C.S.I. injection by stallion, and (v) date of embryo thaw and transfer. BC may request additional details at its sole discretion. BC may deny enrollment for insufficient documentation or non-compliance. No refund shall be provided where denial is based on inadequate or falsified records.

  18. Grade, Cloned, or Non Registered Enrolled Foals. Grade, Cloned, or Non Registered Foals by Enrolled Stallion may be enrolled in the program specific to adhering to additional terms and conditions:

    1. Nominator must complete and fulfill the terms of the Grade Foal Enrollment Declaration at Nominators expense.
    2. Nominator acknowledges and agrees that they have paid all associated breeding fees to the Stallion Owner for the foal designated herein.
    3. Nominator agrees to be solely liable to incur all Veterinary Fees associated with Horse Declaration and Microchip Implantation.
    4. Owner agrees to be solely liable to incur all Veterinary Fees associated with Horse Confirmation Services provided by the Event Onsite Veterinarian prior to competition at each Breeders Challenge, LLC Sanctioned Event.
    5. Owner acknowledges the Veterinarian will complete a declaration confirming or denying the Horse’s identity. Should there be any question or discrepancy found by the Inspecting Veterinarian, their declaration is final and Breeders Challenge, LLC will adhere to approval or deny status of identity. The Veterinary Services must be provided no later than 24 hours preceding the Horse’s first run and a Breeders Challenge, LLC attendee must be present for the examination to sign as witness.
    6. Nominator acknowledges and agrees that should they sell the Horse they must inform the Buyer in writing of this declaration and entry requirements.
    7. Nominator acknowledges and agrees that Breeders Challenge, LLC shall bear no liability, responsibility, or obligation arising from or related to this foal enrollment, including but not limited to disputes, claims, injuries, losses, or future issues involving the horse or the Nominator.
    8. Breeders Challenge, LLC retains all rights at their sole discretion to amend and/or update rules involving GRADE horses to be applied to current and existing nominated GRADE horses. Nominator acknowledges and agrees to adhere and cooperate should future amended and/or updated rules need be applied to the GRADE horses in the program.

Article II

Unconditional Release

  1. PARTICIPANTS ACKNOWLEDGE THAT THEY HAVE READ AND AGREE TO THIS RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT (this “Release”) and further agree that no oral representations, statements or inducements apart from the foregoing written agreement have been made. BC has the right to refuse participation to anyone for any reason it deems necessary, including but not limited to classification issues. Questions or concerns should be directed to the BC Office at (940) 204-9911.

  2. Each Participant is fully aware, completely understands, and accepts that participation in a BC event, whether as a contestant, independent contractor, employee, volunteer, exhibitor, sponsor or spectator, is dangerous and that the events and activities associated with, relating to, arising out of, and concerning this participation present substantial, serious, and real risks of personal injury or death to the Participant, and the risk of loss, damage, or destruction of the Participant’s personal property including livestock. To the fullest extent permitted by law, each Participant releases BC and the Released Parties (defined below) from claims and damages arising from participation in events, including claims resulting from ordinary negligence of the Released Parties.

  3. IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN BC AND ITS INDIVIDUAL EVENTS OR ADD-ON EVENTS, THE PARTICIPANTS, FOR THEMSELVES AND ALL PERSONS UNDER THEIR MANAGEMENT OR CONTROL, INCLUDING WITHOUT LIMITATION MINOR CHILDREN, HEREBY ACKNOWLEDGE THAT PARTICIPANTS ARE FULLY AWARE, COMPLETELY UNDERSTAND, AND ACCEPT THAT PARTICIPATION IN A BC EVENT, WHETHER AS A CONTESTANT, INDEPENDENT CONTRACTOR, EMPLOYEE, VOLUNTEER, EXHIBITOR, SPONSOR OR SPECTATOR, IS DANGEROUS AND THAT THE EVENTS AND ACTIVITIES ASSOCIATED WITH, RELATING TO, ARISING OUT OF, AND CONCERNING THIS PARTICIPATION PRESENT SUBSTANTIAL, SERIOUS, AND REAL RISKS OF PERSONAL INJURY OR DEATH TO THE PARTICIPANT, AND THE RISK OF LOSS, DAMAGE, OR DESTRUCTION OF THE PARTICIPANT’S PERSONAL PROPERTY, INCLUDING WITHOUT LIMITATION LIVESTOCK. TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTICIPANT RELEASES AND DISCHARGES BC AND THE RELEASED PARTIES (DEFINED BELOW) FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, OR DAMAGES ARISING OUT OF OR RELATING TO PARTICIPATION IN BC ACTIVITIES, INCLUDING WITHOUT LIMITATION CLAIMS ALLEGING THE ORDINARY NEGLIGENCE OF BC OR THE RELEASED PARTIES, WHETHER OR NOT APPARENT, KNOWN, UNKNOWN, FORESEEN, UNFORESEEN, PRESENT, OR CONTINGENT, AND WHETHER OR NOT CAUSED BY ANY NEGLIGENCE OF THE RELEASED PARTIES OR ANY NEGLIGENCE OF ANY PARTICIPANT, VOLUNTEER OR SPECTATOR, INCLUDING BUT NOT LIMITED TO ANY NEGLIGENCE ASSOCIATED WITH THE DESIGN, STAGING, SUPERVISING, MAINTAINING OR IN ANY WAY PRESENTING, CONDUCTING OR SPONSORING THE EVENT. PARTICIPANTS FURTHER AGREE TO USE EXTRAORDINARY CARE AND PRUDENCE IN THEIR ACTIVITIES AND THOSE OF CHARGES, AND PARTICIPANTS HEREBY (A) RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE BC, THE RELEASED PARTIES, THE ORGANIZERS OR ANY SUBDIVISION THEREOF, SPONSORS, CHAIRMEN, AGENTS, OFFICIALS; AND (B) AGREE TO INDEMNIFY, DEFEND, SAVE, AND HOLD HARMLESS BC, ITS OWNERS, SPONSORS, AGENTS, VENUE OWNERS AND REPRESENTATIVES, SERVANTS, EMPLOYEES, AND OTHER REPRESENTATIVES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY THIRD-PARTY CLAIM, DEMAND, OR LIABILITY FOR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION PERSONAL INJURIES OR PROPERTY DAMAGE ARISING FROM THE PARTICIPANT’S ACTS OR OMISSIONS. PARENTS OF RIDERS YOUNGER THAN EIGHTEEN (18) WHO PARTICIPATE ACKNOWLEDGE THE FULL AND UNCONDITIONAL RELEASE FOR PARTICIPATION FOR THEIR CHILD. NOTHING IN THIS RELEASE PURPORTS TO WAIVE LIABILITY TO THE EXTENT SUCH WAIVER IS PROHIBITED BY LAW.
  4. Participant authorizes BC and event medical/veterinary personnel to secure emergency medical treatment for Participant and emergency veterinary care for Participant’s horse(s) if, in their reasonable judgment, delay would jeopardize health or safety. Participant remains responsible for all related costs.

  5. Participant grants permission to BC and affiliated entities to use photographs, videos, recordings and/or words said by Participants in its promotional and advertising materials without notification or compensation. Participant waives any right to inspect or approve finished materials and releases BC from claims based on rights of privacy or publicity arising from authorized use.

  6. Participant fully understands and agrees that this Release is to be interpreted and applied in the broadest and most comprehensive manner in favor of the Released Parties. The Participant agrees that he or she has full power, authority, capacity and right without limitation to sign, deliver and perform this Release. This Release shall be and is binding upon the Participant and his or her spouse, legal representatives, heirs, successors and assigns. The undersigned agrees that the laws of the State of Texas govern this Release. The Participant also agrees that upon entry to any event, he or she has read and understands said agreement whether the signature has been returned or not. Parents or legal guardians signing for a minor Participant represent and warrant that they have authority to do so and agree to this Release on the minor’s behalf.

Article III

Event Conditions

Division A

Open Futurity.

BC will host qualifier races advancing twenty (20) teams per qualifier to the end-of-year BC Semi Finals, and thirty (30) advancing teams to the BC Finale.

  1. The payout will be 1D / 2D average paying 10 holes deep in each D. The 2D will be a full second split. The aggregate will pay 70% of the 80% payout with 60% paying to the 1D and 40% paying to the 2D.

    1. Go-Round 1 – the fastest 10 teams will advance to the BC Semi-Finals. Go-Round will pay 5 holes deep at 15% of the 80% payout.
    2. Go-Round 2 – the fastest 10 teams will advance to the BC Semi-Finals. Go-Round will pay 5 holes deep at 15% of the 80% payout.
  2. Should a team qualify in each Go-Round, their slowest advancing time will be dropped, and the next fastest team will qualify for the BC Semi-Finals. Should a team have qualified at a previous qualifier, they will be ineligible to secure a qualification spot on the same horse at a later qualifier.

  3. Offspring must be enrolled in BC to qualify for a race entry. Offspring that are four (4) or five (5) years of age may compete. A copy of the offspring registration papers including the backside must be on file with BC prior to race entry. All AQHA and APHA offspring must be registered to compete. In the event enrolled offspring are outside of AQHA and APHA registry, Grade Rulings apply. They will be mouthed prior to race entry and approval, or denial of entry will be at the discretion of BC with no refund should the horse show to be older than disclosed age. There shall be no refund in the event BC determines, in its sole and absolute discretion, that the offspring appears to be older than the disclosed age. Offspring may not have competed for any financial compensation prior to their announced futurity season beginning November 15th of the preceding year. Failure to comply will result in disqualification without refund.

  4. Offspring substitutions are permitted for qualifier races. The offspring substitutions must be declared in writing prior to office check-in of race entry should they differ from the original entry designation. A $100 substitution fee will be charged.

  5. Offspring substitutions are not permitted for the final race. Qualified offspring will be the only approved horses to compete.

  6. Rider substitutions are permitted for qualifier races. Rider substitutions must be declared in writing prior to office check-in of race entry should they differ from the original entry designation. A $100 substitution fee will be charged.

  7. Offspring futurity runs may be rolled over into the open 4D qualifier so long as the entry is paid prior to the offspring running. Should offspring be paid into both the futurity and open 4D, such offspring will run in the futurity.

  8. Late entries will be allowed by the discretion of the hosting producer’s rulings. Late entries will be last in the draw and incur a late fee of $100 that shall be due prior to race start.

  9. Check-ins will be at the discretion of the hosting producer. All rulings in place by the producer will be adhered to by Participants. Failure of Participants to comply will result in potential disqualification.

  10. A qualifier entry slot may be sold up to fourteen (14) business days preceding the race should a discrepancy arise with the entered offspring or Rider. The completed and signed form for slot sales must be emailed or mailed to BC. The applicable rules and guidelines apply to the purchaser of the slot. BC is not responsible for the transaction between buyer and seller; no refund or discount will be provided to either party.

  11. Entry scratches are allowed for entry fee rollover toward a future event with a signed veterinary statement forty-eight (48) hours in advance of race start. A $100 penalty will be assessed to each scratch.

  12. Notwithstanding anything to the contrary, all entries are final and no discount or refund of any kind will be provided.

  13. Participants understand and agree that entry to any of the aged event divisions of Breeders Challenge requires Participant enter the hosting producers aged event race. Participants are not allowed to rollover from the Open 4D Races, Youth Races, or Senior Races to the aged event races.

    1. Open Futurity – Participants must enter the host producers Open Futurity to rollover to the Breeders Challenge Open Futurity.
      1. One or both runs can rollover to the Breeders Challenge Open 4D Race 1 and/or Race 2. Go Round 1 will roll to Open Race 1 and Go Round 2 will roll to Open Race 2. A separate entry fee applies. Participant does not have to enter the host producer’s Open Race for rollover if entered in host producer’s Open Futurity.
      2. One or both runs can rollover to the Breeders Challenge Youth or Senior if Participant is age appropriate for either. As the event results for qualification and payout include 2 entry opportunities, the run from Go Round 1 and/or Go Round 2 can roll. A separate entry fee applies. Participant does not have to enter the host producer’s Youth or Senior race for rollover if entered in host producer’s Open Futurity.

All qualified semifinalists will compete with two (2) opportunities for finale advancement. The semifinals payout will be $25,000 added to each Go-Round with an optional $500 entry fee that applies to both Go-Rounds ($250 to each Go-Round). Payout will be a 1D / 2D split paying ten (10) holes deep in each D with a 0.6-second split. The 1D will pay 60% of the 80% payout and the 2D will pay 40% of the 80% payout. If participant DOES NOT pay the $500.00 semifinals entry fee, they will be competing solely for a qualification spot to the finale. Only participants that pay the $500.00 semifinals entry fee will be eligible for the added money and payout.

  1. Participants may elect to run in both Go-Rounds (Go-Round 1, or Go-Round 2). If a Participant intends to draw out of either Go-Round, such Participant must do so one (1) hour prior to race start time with the office.
  2. Go-Round 1: the fastest fifteen (15) teams will advance to the BC Finals. Should a team qualify in Go-Round 1, such team does not have to run in Go-Round 2 but may do so if such team elects to run for payouts. The draw order will be randomized.
    1. Drag every three (4) runners and big drag every thirty (40) runners.
  3. Go-Round 2: the fastest fifteen (15) teams will advance to the BC Finals.
    1. The draw order will be the reverse order of Go-Round 1.
    2. Drag every three (4) runners and big drag every thirty (40) runners.

Should a team qualify in each Go-Round, the slowest advancing time will be dropped, and the next fastest team will qualify for the BC finale.

Division B

Amateur Derby.

BC will host qualifier races advancing 10 teams per qualifier to the end of year BC Finale. All qualifiers will compete for the Finals and guaranteed payout.

Qualifier Races
  1. Rider must provide BC with his or her Association Amateur Card with entry to race. Rider understands and agrees to the terms associated herein qualifying and holding an amateur card. Should a Rider be found to be in non-compliance with the terms of their amateur status, such Rider will be disqualified. Rider will have fourteen (14) days from receipt of disqualification to return 100% of prize moneys, prizes, and awards to BC for redistribution to eligible Participants.

  2. Rider may not receive nor have received any monetary compensation for riding or training horses for the outside public.

  3. All Riders must be 18 years of age or older. Riders under 18 years of age are ineligible for the Amateur Derby. As AQHA Amateur Status is for 19 years of age and older, 18-year-olds will be eligible to compete so long as they sign the Amateur Status waiver agreeing to abide by the terms and conditions therein.

  4. Rider must own the offspring they enter. Proof of legal entity, Ranch Name, or Familial Relation must be provided if the Riders name is not designated on the registration papers. The payout will be a two Go-Round aggregate paying 10 holes deep straight pay. The aggregate will pay 70% of the 80% payout.

    1. Go-Round 1 – The fastest 5 teams will advance to the BC Finale. Go-Round will pay 5 holes deep at 15% of the 80% payout.
    2. Go-Round 2 – The fastest 5 teams will advance to the BC Finale. Go-Round will pay 5 holes deep at 15% of the 80% payout.

    Should a team qualify in each Go-Round, such team’s slowest advancing time will be dropped, and the next fastest team will qualify for the BC Finals. Should a team have qualified at a previous qualifier, such team will be ineligible to secure a qualification spot on the same horse at a later qualifier.

  5. Offspring that are 5 – 8 years of age may compete. A copy of the offspring registration papers including the backside must be on file with BC prior to race entry. All AQHA and APHA offspring must be registered to compete. In the event enrolled offspring are outside of AQHA and APHA registry, Grade Rulings apply. They will be mouthed prior to race entry and approval, or denial of entry will be at the discretion of BC with no refund should the horse show to be older than disclosed age.

  6. Offspring must be enrolled in BC to qualify for race entry.

  7. Offspring may not have competed for any financial compensation prior to their announced futurity season beginning November 15th of the preceding year. Failure to comply will result in disqualification.

  8. Offspring substitutions are not permitted for the qualifier races unless the terms of Amateur Status apply to Offspring Substitution. They must be declared in writing prior to office check in of race entry should they differ from the original entry designation. A $100 substitution fee will be incurred.

  9. Offspring substitutions are not permitted for the final race. The qualified offspring and rider combination will be the only approved teams to compete.

  10. Rider substitutions are not permitted for the qualifier races unless the terms of Amateur Status apply to Rider Substitution. They must be declared in writing prior to office check-in of race entry should they differ from the original entry designation. A $100 substitution fee will be incurred.

  11. Rider substitutions are not permitted for the final race. The qualified offspring and rider combination will be the only approved teams to compete.

  12. Offspring Derby runs may be rolled over into the Open 4D qualifier so long as the entry is paid prior to the offspring running. Should offspring be paid into both the Derby and Open 4D, they will run in the Derby.

    1. Late entries will be allowed per the discretion of the hosting Producer’s rulings. Late entries will be last in the draw and incur a late fee of $100 due prior to race start.
    2. Check In will be per the discretion of the hosting Producer. All rulings in place by Producer will be adhered to by BC Participants. Failure to comply may result in disqualification.
  13. A Qualifier Entry Slot may be sold up to fourteen (14) business days preceding the race should a discrepancy arise with the entered offspring or rider. The completed and signed form for Slot Sales must be emailed or mailed to BC. The applicable rules and guidelines apply to the purchaser of the slot. BC is not responsible for the transaction between buyer and seller; no refund or discount will be provided to either party.

  14. Entry Scratches are allowed for entry fee rollover toward a future event with a signed veterinary statement 48 hours in advance of race start. A $100 penalty will be assessed to each scratch.

  15. All entries are final. No discount or refund of any kind will be provided.

  16. Amateur status complaints must be filed in writing and proof of foul play must be documented. Any false accusations toward another Participant will not be tolerated and the accuser shall incur the same disciplinary action or ruling by BC should they fail to provide accurate proof of such accusation. Any disciplinary action or ruling by BC will be considered final.

  17. Participants understand and agree that entry to any of the aged event divisions of Breeders Challenge requires Participant enter the hosting producers aged event race. Participants are not allowed to rollover from the Open 4D Races, Youth Races, or Senior Races to the aged event races.

    1. Amateur Derby – Participants must enter the host producers Amateur Derby to rollover to the Breeders Challenge Amateur Derby. IF host producer does not host an Amateur Derby, Participant must enter the host producer’s Open Derby to rollover to the Breeders Challenge Amateur Derby.
      1. One or both runs can rollover to the Breeders Challenge Open 4D Race 1 and/or Race 2. Go Round 1 will roll to Open Race 1 and Go Round 2 will roll to Open Race 2. A separate entry fee applies. Participant does not have to enter the host producer’s Open Race for rollover if entered in host producer’s Amateur Derby.
      2. Participant may rollover their time from the Amateur Derby to the Open Derby or vice versa. Run order with the first race of the day will take precedence as the appointed time for rollover. A separate entry fee applies.
  18. Amateur Derby entries may also enter the Open Derby. Participants may run as a single entry and roll their times to both the Amateur Derby and Open Derby or they may run as a double entry into The Amateur Derby and Open Derby to have their times be designated separately.

  3. Offspring that are 5 – 8 years of age may compete. A copy of the offspring registration papers including the backside must be on file with BC prior to race entry. All AQHA and APHA offspring must be registered to compete. In the event enrolled offspring are outside of AQHA and APHA registry, Grade Rulings apply. They will be mouthed prior to race entry and approval, or denial of entry will be at the discretion of BC with no refund should the horse show to be older than disclosed age.

  4. Offspring must be enrolled in BC to qualify for race entry.

  5. There is no specification of Offspring competing in the Juvenile or Futurity. All Offspring between the ages of 5-8 may enter and compete in the Derby.

  6. Offspring 5 years of age will be eligible to run through their 8-year-old year.

  7. Offspring substitutions are permitted for qualifier races. They must be declared in writing prior to office check-in of race entry should they differ from the original entry designation. A $100 substitution fee will be incurred.

  8. Offspring substitutions are not permitted for the final race. The qualified offspring will be the only approved horses to compete.

  9. Rider substitutions are permitted for qualifier races. They must be declared in writing prior to office check-in of race entry should they differ from the original entry designation. A $100 substitution fee will be incurred.

All qualified Semi Finalists will compete with 2 opportunities for Finale advancement. The Semi Finals payout will be $25,000 added to each Go-Round with an optional $500 entry fee that applies to both Go-Rounds ($250 to each Go-Round). Payout will be a 1D / 2D split paying 10 holes deep in each D with a 0.6-second split. The 1D will pay 60% of the 80% payout and the 2D will pay 40% of the 80% payout. If participant DOES NOT pay the $500.00 semifinals entry fee, they will be competing solely for a qualification spot to the finale. Only participants that pay the $500.00 semifinals entry fee will be eligible for the added money and payout.

  1. Participants may elect to run in BOTH Go-Rounds, Go-Round 1, or Go-Round 2. If a Participant intends to draw out of either Go-Round, they must do so 1 hour prior to race start time with the office.
  2. Go-Round 1 - the fastest 15 teams will advance to BC Finals. Should a team qualify in Go-Round 1, they do not have to run in Go-Round 2 but may do so if they paid the entry fee and elect to run for payouts. Draw order will be random.

Participants must be fifty (50) years of age or older on January 1st to be approved to compete. The fastest five (5) teams from each qualifier will advance to the BC Finale.   6. The Challenge Races will not be a qualifier; they are added money events to be held at select events.

Qualifier & Finale Rulings
  1. All awards are to be picked up by Participants at the qualifiers and finale. Should awards fail to be picked up, BC is not responsible for left behind awards. Participants will be responsible for the shipping expenses incurred if awards are requested to be shipped in advance of packing. Participants may schedule to pick up awards from the BC office, a one-week notification is required. BC will not hold awards beyond two (2) weeks following conclusion of event and awards will be forfeited. BC is not responsible for lost, delayed, or damaged packages and awards once shipped.

  2. The Finale Draw Party is mandatory for Riders. Should a Rider fail to attend, such Rider will be disqualified and the next team in line will advance to the Finale. Considerations will be made by BC, in BC’s sole discretion, should an emergency occur unexpectedly affecting the Rider. Previously scheduled/sanctioned events must be submitted to BC for approval with proof of scheduling conflict to be considered.

  3. BC will issue checks to Owners, Nominators, and Stallion Owners within fourteen (14) business days following conclusion of the Qualifier, Challenger Race, and Finale. A current year IRS Form W9 must be on file with BC prior to check issuance. BC may delay, withhold, or offset payments against amounts owed to BC, or pending the outcome of event-integrity or animal-welfare investigations, in BC’s sole discretion.

  4. It is the Participant’s responsibility to update BC of any address changes prior to event entry or check issuance. Owners, Nominators, and Stallion Owners receiving checks must adhere to guidelines for prompt payment. Payments unclaimed after one hundred eighty (180) days may be void and handled per BC policy.

  5. The Finale High Stakes Race will be open to any contestant and is not exclusive to BC enrolled horses. As the race will be run in accordance with BC rulings for the Finale; drag every three (4) contestants, big drag every thirty (40) contestants, it will allow Finale contestants to enter by paying a $500 entry fee to roll their Semi-Finals Time(s) and Finale Time(s) to the Slot Race. Each run = 1 entry fee. In addition to the entry fee and payback of 85%, it will include $5,000 added money and awards. It will be run in a 2D format with a full-second split.

Division F

Miscellaneous provisions.

Program-wide terms governing liability, governing law, dispute resolution, integrity, and BC’s reservation of rights.

General Provisions
  1. Limitation of Liability; Reservation of Rights; Rule Changes. BC may cancel, postpone, or change the conditions of all or any part of the program. BC may utilize enrollment fees in any manner it deems appropriate, including without limitation the payment of administrative and promotional costs and expenses. Enrollment fees are non-refundable. By enrolling a foal or stallion, competing in, nominating or owning a horse in the program, or otherwise participating with BC, the Participant agrees to these Rules. The current-year Rules supersede prior statements. BC may, in its sole and absolute discretion (i) amend these Rules at any time and (ii) apply amendments to current or future events as necessary to protect safety, animal welfare, program integrity, or to address misconduct or manipulation, including without limitation adjustments to standings or payouts where warranted. BC may amend the Rules at any time in its sole and absolute discretion. Amendments may take effect immediately or as stated in the notice and may be applied to current or future events as necessary to protect safety, animal welfare, event integrity, or to address misconduct or administrative error (including corrections to draws, postings, and payouts). In the event of a conflict, these General Rules & Conditions control over promotional materials or informal communications; event-specific conditions supplement and control only to the extent of a direct conflict for that event. BC guarantees the program thru the conclusion of executed stallion annual enrollment.

  2. Choice of Law. Participants agree that all matters arising out of or relating to BC-sanctioned events and this Agreement (including, without limitation, issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of the Entrants and Best Maid in connection with the Contest) shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.

  3. Dispute Resolution. As a condition precedent to suit, the parties will participate in good-faith mediation for at least one full session with a mutually agreed mediator; if mediation is not concluded within thirty (30) days after a written request, either party may file suit. Any and all disputes, claims, causes of action, legal suits, actions, or proceedings arising out of or relating to BC, this Agreement, or any BC-sanctioned event shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state courts located in Tarrant County, Texas, and Participants irrevocably consent to the personal jurisdiction of such courts and agree that it is a convenient forum such that Participants will not seek to transfer such action or proceeding to any other forum or jurisdiction, under the doctrine of forum non conveniens or otherwise; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering into the BC-sanctioned event; and (c) UNDER NO CIRCUMSTANCES WILL PARTICIPANTS BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES. The prevailing party in any dispute arising from this Agreement shall recover its reasonable attorneys’ fees and costs (including on appeal and in post-judgment or collection proceedings) from the non-prevailing party.

  4. Final Authority; Interpretation; Clerical Corrections. BC has final authority to interpret, apply, and enforce these Rules and any published event conditions. BC may correct any clerical or scrivener’s errors in draws, results, postings, payouts, or standings. BC’s factual determinations made in good faith are conclusive for purposes of event results, qualifications, and payouts.

  5. Integrity; Anti-Manipulation; Consequences. Any attempt to manipulate event outcomes or program mechanics is prohibited, including without limitation collusion, sandbagging, false entries, device or timer tampering, providing false documentation, or coordinated social media campaigns intended to disrupt BC programs. BC may impose penalties on any involved Participant or Owner, including disqualification, suspension or ban, voiding of results, forfeiture of fees already applied to event operations, withholding of unpaid amounts, and recoupment of amounts paid in error or obtained through misconduct.

  6. Verification; Cooperation; Audit Rights. Participants and Owners must promptly provide records reasonably requested by BC to verify eligibility, age, ownership, amateur status, enrollment, and compliance (including registration papers, identification, and veterinary statements). BC may interview Participants and Owners and inspect credentials onsite. Failure to provide requested documentation or to cooperate is grounds for disqualification, denial of entry, or suspension.

  7. Withholding; Offset; Clawback. BC may withhold or offset amounts otherwise payable to cover fees owed to BC, outstanding fines, returned payment charges, or pending ruling(s). If BC later determines that a payout was made in error or in violation of these Rules, BC may require repayment and pursue lawful collection; continued participation may be conditioned on repayment.

  8. Taxes; Reporting. Participants and payees are solely responsible for all taxes arising from participation and payouts. BC may require a current IRS Form W-9 (or applicable foreign form) and may issue IRS information returns. BC is not responsible for a payee’s tax penalties; backup withholding may apply where required by law.

  9. Safety & Security. BC may remove or refuse entry to any person, horse, or equipment when, in BC’s sole and absolute discretion, safety, animal welfare, or event integrity would be compromised, including without limitation apparent intoxication/impairment, dangerous tack or behavior, or health-document noncompliance, and no refund shall be required.

  10. Non-Assignment. Except as expressly permitted in these Rules (e.g., approved slot sales or substitutions), entries, qualifications, and positions are personal to the original entrant and may not be assigned, sold, or transferred without BC’s written consent. Any unapproved transfer is void and subject to disqualification without refund. BC may assign its rights or delegate its obligations to an affiliate or event partner.

  11. Notices. Participants consent to receive notices by email, text/SMS, phone/voicemail, portal posting, or certified mail at the last contact information provided to BC. Electronic signatures and acceptances (including click-throughs and portal acknowledgments) are valid and enforceable for all BC documents and entries.

  12. Severability; No Waiver; Construction. If any provision of this Agreement is found unenforceable, all remaining provisions hereof will remain in full force and effect to the fullest extent permitted by applicable law. BC’s failure to enforce a provision shall not constitute a waiver or otherwise restrict BC from enforcing such provision in the future. The headings herein are for convenience only, do not constitute a part of this Agreement, and shall not be deemed to limit or affect any of the provisions hereof. No rule or provision will be construed against BC as drafter.
